Fortressa Terms of Service

Thank you for using Fortressa.

These Terms of Service ("Terms") apply to your use of our web site, products, and services. Please read them carefully and let us know if you have any questions. By using Fortressa, you agree to be bound by these Terms. If you are using Fortressa on behalf of an organization, you agree to these Terms on behalf of that organization.

Uploaded Content

Any files you upload to Fortressa belong to you, and you are responsible for obtaining any relevant licenses applicable to those files. If we learn of prohibited material stored on our service, we reserve the right to remove said prohibited material.

Service Abuse

Please use this service with respect for other people. If we notice abuse, such as crypto-currency mining, excessive CPU usage, or excessive data transfers, abusers will be given a warning. If the abusive behavior is not corrected after this warning, the offending account may be terminated if the abusive behavior is not corrected.

Reporting abuse: If you notice any abuse or unauthorized material on our servers, please let us know via abuse@fortressa.com, and we will review such submissions within 48 hours. If the behavior and/or material is determined, in our sole discretion, to be in violation of these Terms, the offending material and/or accounts will be removed.

Payments and Billing

Fortressa is a hosting service, and as such we provide no guarantees as to how, or how well, any of the apps and services we provide will work, as those apps and services are supplied by third parties.

All Fortressa products and services are priced in United States dollars (USD). Payments are processed securely via Stripe Inc. When entering your credit card information, all payment details will be stored securely with Stripe Inc., and Fortressa never sees or retains your credit card details.

If you notice any errors in the charges billed to you, please contact us so we can rectify the problem.

Refund Policy

Plan subscription charges are non-refundable. For the purpose of EU directive 2011/83/EU, resources are allocated to you at the time your subscription begins, and the delivery of our service starts at the time payment is made related to that subscription, and you acknowledge the loss of your right to withdraw from the contract at that time.

Unpaid Accounts

If you do not have an active and valid payment method on file when your subscription expires, we will pause your services and ask you to add a valid payment method. If your account remains unpaid for more than 30 days, we will assume you no longer need the service and remove your data from our system.

Trademarks

All app product names and trademarks are the property of their respective owners, which aside from the Fortressa service itself, are in no way associated or affiliated with us. Product names are used solely for the purpose of identifying the specific products that can be deployed by our customers on our service in an unmodified form. Use of these names does not imply any co-operation or endorsement unless stated otherwise.

Data Backups

We store server-wide backups of all user data off-site in a separate geographic location. This includes snapshots of past data. If you need to restore data for a single application, we can provide you with a snapshot of your data in exchange for a small administrative fee. In the future, this may be automated and become available as a separate service.

Limitation of Liability

To the fullest extent allowed by law, Fortressa shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from (1) your access to, use of, inability to access, or inability to use our service; (2) any third-party conduct or content on Fortressa, including any defamatory, offensive, or illegal conduct of third parties; or (3) any unauthorized access, use, or alteration of your content.

Linked Products and Services

We are proud to be part of a wider community, which includes different open-source projects and complementary services. Sites that we link to may contain links to web sites, services, and advertisements that we neither own nor control. We do not endorse or assume responsibility for any third-party sites, information, materials, products, or services.

Entire Agreement

These Terms and our Privacy Policy constitute the entire agreement between you and Fortressa. If any provision of these Terms is found to be unenforceable, the remaining provisions of these Terms will remain in full force and effect.

Modification

The Terms may be modified from time to time. If we make changes that we believe will substantially alter your rights, we will notify you. By continuing to use our service, you agree to accept any changes or revisions to the Terms.
